Court rejects woman’s attempt to prevent former partner from continuing as children’s mother

10 December 2017

A Scottish woman filed for a "declaratory" of non-parentage against her former female partner when the relationship came to an end.  The woman had given birth to twins by artificial insemination and the former partner had no biological connection to the twins.

The application was rejected by the court and the case reminds us that when a same-sex couple has a child together the non-biological parent will have the same rights and responsibilities as the biological parent.
