Married couple living apart can be surrogate child’s legal parents

Sir James Munby, the most senior family court judge in England and Wales, has ruled that a married couple who live apart may be the legal parents of a child born as a result of a surrogacy arrangement. The parents have been married for a number of years and, as one of them is gay, they each have seperate homes. The child is familiar with both homes and spends time equally between them.
