Single people to be allowed to apply for a Parental Order following surrogacy

The High Court has ruled that only allowing couples to apply for a parental order, transferring legal parenthood from a surrogate to the intended parent, is incompatible with the European Convention on Human Rights.  This follows a ground-breaking court case involving a single father whose child was carried by a surrogate mother.

The Government is now to make a Remedial Order which will allow this part of the law to be changed and enable a single parent to apply for a parental order following a surrogacy arrangement.
