Arizona Ruling on Fate of Frozen Embryos after Parties Separate

19 April 2018

The Governor of Arizona has ruled that frozen embryos of a former couple should be given to the party who wants to use them for pregnancy, regardless of the wishes of the other party.  The other party will have no legal responsibility for the resulting child.

Controversially, the ruling states that if both parties want the embryos, the embryos should be given to the party who is clinically the most likely to achieve a pregnancy, which could lead to discrimination against older women.
