The Government’s response to the Biodiversity Net Gain Consultation

The Government has this week published its response to the Biodiversity Net Gain ("BNG") consultation held between January and April 2022.

While there are still some details to be finalised, it confirms that the requirement for developers to provide at least a 10% increase in biodiversity for each development will come into effect for most sites from November 2023 (with a transition period to April 2024 for small sites). 

It has also confirmed that exemptions to the BNG requirements will be made for developments affecting habitats of less than 25 metres squared, householder applications and small scale self-build, and sites where habitats are being enhanced for wildlife.
