Associate, Lisa Payne has written an article for Today's Family Lawyer discussing Prenuptial agreements.

Prenuptial agreements (PNAs) remain a significant topic for family lawyers, consistently featured in legal discussions. The Law Commission's 2014 scoping report highlighted the ongoing need to address nuptial agreements, recommending the introduction of binding ‘Qualifying Nuptial Agreements’ (QNAs). These agreements would need to meet specific conditions and could only be challenged if they failed to meet the needs of a party or child adequately.

The recent report from the Law Commission reiterated these recommendations but emphasised that the Government must first consider wider financial remedies reform before tackling binding nuptial agreements. 

Clearer guidance is necessary for both legal practitioners and their clients.
