The Prime Minister used TikTok to promote reforms to what he called the “outdated” leasehold system. While conveyancers have welcomed the proposed £250 cap on ground rents, the move to make commonhold the default form of tenure raises practical concerns.

In an article for Law Society Gazette, partners Kate Stockdale and Michael Ellis, give their thoughts.

Kate says conveyancers will welcome the £250 ground rent cap as it should remove 'one of the most persistent sources of delay and uncertainty' in residential transactions. Kate continues 'Many long leases contain opaque or aggressively escalating rent review clauses, which can be difficult for buyers, lenders and practitioners to interpret and often trigger additional enquires or lender conditions. A clear cap would simplify due diligence and make it easier to advise on future liabilities.'
