Martha Swann

Senior Associate

Martha is an senior associate in the Probate and Estate Administration team. She joined Wilsons LLP in February 2020 and is a full member (TEP) of the Society for Trusts and Estate Practitioners (STEP).

She studied Theology at Durham University. After working in IT and Recruitment for a number of years, she completed her GDL and LPC (Commendation) in 2009 and qualified in 2011. She moved to Dorset in 2013 and worked for Trethowans until 2020.

Martha provides advice in relation to all aspects of Private Client work, however her practice has a particular focus on estate administration, including (but not limited to):

  • Advice and work in relation to all sizes of estates, including complex U/HNW estates and those which are dutiable for inheritance tax ("IHT");
  • Providing advice in relation to estates where claims for Agricultural Property Relief, Business Property Relief and & heritage/conditionally exempt assets etc are to be made;
  • Advising on estate administration where there are overseas/foreign jurisdictional interests which require resealing of Grants or application for foreign Grants;
  • Provision of advice and work in relation to estates with charitable interests (including where charities are named executors and/or beneficiaries);
  • Provision of additional advice in respect of estate income tax and capital gains tax, including the utilisation of appropriations and deeds of variation etc;
  • Preparing and advising on applications for "unusual" grants (for example ad colligenda bona or de bonis non) and s.116 Senior Courts Act 1981 applications
  • Advising on estates where there are IHT exempt/non-exempt beneficiaries or partial intestacy;  
  • Assisting in estates where the administration is incomplete or has been carried out incorrectly including providing assistance where required in rectification on behalf of executors/administrators.

When not at work. Martha enjoys going to the gym, making the most of living in Dorset (including walking or kayaking or sailing) and collecting recipe books (and occasionally cooking from them). She is also owned by two cats.
